These Terms of Use and End User License Agreement (“Terms” or “EULA”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Etha Labs (“we,” “us,” “our,” or “Company”) governing your access to and use of the Etha VPN mobile application and services (collectively, the “Service”).
By downloading, installing, accessing, or using Etha VPN, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Etha VPN application on your personal mobile device solely for your personal, non-commercial use.

Etha VPN offers auto-renewable subscription plans with various billing cycles (monthly, yearly, or other periods as specified in the app). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Subscription prices are displayed in the app and may vary by region. We reserve the right to modify pricing with advance notice to existing subscribers.
Payments are processed through Apple’s App Store. Your subscription will be charged to your Apple ID account at confirmation of purchase.
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for the unused portion of any subscription period.
If we offer a free trial, you will be charged when the trial period ends unless you cancel before the trial expires. Free trials are limited to one per user.
All sales are final. Refunds are subject to Apple’s refund policy. To request a refund, contact Apple Support directly.
You agree to use Etha VPN in compliance with all applicable laws and regulations. You are solely responsible for your conduct and any content you access while using the Service.

While we strive to provide reliable and uninterrupted service, we do not guarantee that the Service will be available at all times or free from errors, delays, or interruptions. We may modify, suspend, or discontinue the Service at any time without notice.
VPN connection speeds may vary based on numerous factors including your internet connection, server load, and geographical location. We do not guarantee specific connection speeds.
We reserve the right to add, remove, or modify server locations at our discretion without prior notice.
All rights, title, and interest in and to the Service, including all software, technology, content, trademarks, and other intellectual property, are and will remain the exclusive property of Ethalabs and its licensors.
“Etha VPN,” the Etha VPN logo, and other marks are trademarks of Ethalabs. You may not use these trademarks without our prior written permission.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without compensation to you.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT:
You use the Service at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETHALABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Ethalabs, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

You may terminate these Terms at any time by canceling your subscription and deleting the app from your device.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or on our website with a new “Last Updated” date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.
The Service may not be available in all countries. You are responsible for complying with local laws regarding online conduct and acceptable content. You may not use the Service in violation of U.S. export laws and regulations or the laws of the jurisdiction in which you reside.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in San Francisco, California.
You agree that any arbitration or proceeding shall be limited to the dispute between you and Ethalabs individually. TO THE FULL EXTENT PERMITTED BY LAW, NEITHER YOU NOR ETHALABS WILL PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.
Notwithstanding the above, either party may bring a claim in small claims court if it qualifies. Additionally, either party may seek equitable relief in court for infringement or misuse of intellectual property rights.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Etha Labs regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms without restriction.
We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, internet failures, or government actions.
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party services.
These Terms are provided in English. Any translations are provided for convenience only, and the English version shall prevail in case of conflict.
